NJOY is the trade name of Sottera, Inc. - an American company manufacturing and distributing electronic cigarette and vaping products in all 50US states and in Europe. Known in the industry as the producer of the Standard Reference Electronic Cigarette the standardized device cleared for use in independent, government-funded studies approved by the National Institute of Drug Abuse, in 2010, Njoy had won a landmark lawsuit against the Food and Drug Administration. The decision by the US Court of Appeals upheld a lower court ruling finding that the FDA lacked authority to regulate electronic cigarettes as drugs or medical devices, absent therapeutic claims. The court further held that FDA could seek to regulate electronic cigarettes via the FDAs authority under the Family Smoking Prevention and Tobacco Control Act of 2009, as argued by NJOY. In March 2023 it was announced that NJoy had been acquired by Altria (NYSE:MO) - a Virginia based producer and marketer of tobacco, cigarettes and related products.
